Additional terms and conditions for paid for services

THESE TERMS AND CONDITIONS ("Additional Terms") govern the paid for services provided to you via jobs.barrettclark.com ("the Website") and operate in addition to the terms displayed here ("the Terms"). Defined terms used in the Terms shall apply to these Additional Terms unless the contrary is stated herein.

1. Definitions

   "Credits" means pre-paid credits which can be redeemed for Services to be provided by the Administrator via the Website.

   "Services" means such services as are selected and paid for by you via the Website.

2. The Services
   1. In consideration for you redeeming the appropriate number of Credits as displayed on the Website from time to time and subject to the Terms and these Additional Terms, the Administrator shall provide or grant you access to the Services that you have selected on the Website.
   2. By requesting Services or by purchasing Credits you warrant that you have the right, authority and capacity to enter into and be bound by these Additional Terms and that you agree to be bound by these Additional Terms forthwith.
   3. In the event that the Administrator, in its sole discretion, considers that you are making any illegal and/or unauthorised request for Services, and/or your use of the Services is in breach of these Terms, the Administrator reserves the right to take any action that it deems necessary, including terminating without notice the provision of the Services and, in the case of illegal use, instigating legal proceedings.
   4. The Administrator may suspend the Services for any reason whatsoever, including but not limited to repairs, planned maintenance or upgrades to the Website, and shall not be liable to you for any such suspension.
3. Payments
4. No Services shall be provided until the appropriate number of Credits have be redeemed by you.
5. Credits can be purchased via the Website at the price displayed at the time of purchase. Credits shall remain valid for a period of 12 months after purchase.
6. No refunds shall be payable for any unused or expired Credits
7. Term and Termination
   1. These Additional Terms will remain in full force and effect while you are using any Services or purchasing or holding any valid Credits.
   2. Clauses 4.2, 5.1, 5.2, 6.2, 6.3 and 6.4 inclusive shall survive termination of these Additional Terms for any reason.
8. Database Access and Data Protection
   1. Where purchasing Services entitles you to search or gain access to information and contact details relating to potential employees who have made Submissions to the Website, you agree that you shall only use to consider their suitability for positions within your organisation or to contact them in relation to the same.
   2. You agree not to contact any person whose details you have obtained from the Website unless you reasonably believe that you have an employment vacancy that may be of interest to that person. You expressly agree that you shall not use any information obtained from the Website for marketing purposes or do anything that may put the Administrator in breach of its obligations under the Privacy Policy.
9. Warranties and Liabilities
   1. The Administrator cannot guarantee and does not promise any specific results from use of the Services.
   2. The Administrator shall not be liable for any loss, injury or damage caused in whole or in part by the Services or the information provided thereby, or by any failure, delay, interruption or otherwise of the provision of the Services or the information provided therein, or by the Administrators failure to perform any of its obligations under these Additional Terms.
   3. To the maximum extent permitted by law, the Administrator expressly excludes all representations, warranties, obligations and liabilities in connection with the Services.
